Premises liability can be tricky in some cases, and if you get hurt on someone else’s property, you may have questions you would like to get answers to. Here are a few situations that could occur and the way you can address what you do next.

Consider traveling to a hotel. If you fall and hurt yourself, is the hotel liable?

That is a good question, and what you’ll need to do is show that the property owner or staff was negligent. For example, if you slip and fall on a broken piece of flooring that was already known about, then you could claim that the property should have repaired or marked the hazard before you hurt yourself.

Who is responsible if I’m injured in a fire in my apartment building?

Building owners are responsible for making sure they exercise reasonable care. That means that they should be marking exit routes, providing sprinklers in appropriate situations and having other safeguards like fire alarms and fire extinguishers on the premises.

Can I seek compensation for my injury if I was a social guest?

If you’re invited to another person’s home, you may be able to seek damages. The amount you can claim will depend on if you were hurt because of a hazard that the homeowner should have told you about. Here’s an example. If you’re invited into the home for a pool party and cut yourself on broken tiles that you weren’t told about, the homeowner may be liable for your injuries. The homeowner should have told you about the hazard.
