Dos hombres atropellados en un parque por un conductor presuntamente ebrio en un todoterreno

9/9/2013

Around 12:26 pm on Aug. 27, a 65-year-old Massachusetts woman driving an SUV struck and knocked down two men who were chatting as they stood on the grass near Winnekenni Basin. She was backing her 2011 Chevy Equinox out of a parking space when the accident occurred. When asked by bystanders if she was in diabetic shock, the woman allegedly replied by saying that she was just an alcoholic. According to bystanders, she allegedly stated that she was unaware that driving under the influence was against the law. The police officer at the scene noted finding three full bottles of wine, two more that were half-empty, as well as three empties on the floor and the passenger seat of her vehicle.

One of the victims, an 88-year-old North Andover man, was taken to Lawrence General Hospital with non-incapacitating injuries. The other, a 63-year-old man, was able to drive himself to Lawrence General to check for injuries. The driver of the SUV refused medical treatment when it was offered by an EMT, according to the police report.

The police officer didn’t give her a sobriety test because she could not stand up on her own. She was taken into custody at the scene of the accident for operating a vehicle while under the influence. She was arraigned in Haverhill District Court and released on her own recognizance under the condition of attending a Structured Outpatient Addiction Program, AA meetings, and remaining alcohol and drug free. Her court date was set for a Sept. 18 pre-trial hearing.

An experienced local personal injury attorney may be able to help people in and around the Lawrence and Essex areas whose lives have been impacted by a car accident injury. An attorney could use broad investigation techniques, which may include a collection of any available witness statements, medical records and police reports to help in building a strong personal injury case.
